SSI is providing an estimate. The client shall pay SSI as set forth in the estimate. Price is subject to change, with the customer’s approval, if the void under the slab is greater than anticipated.
There is a $400 minimum charge for SSI to make an attempt to lift, or to cover material and labour costs, whichever is greater.
SSI shall invoice the client upon completion of work. Payment is due within 10 days of receipt of invoice. A late charge of 3% per month applies to all balances unpaid 30 days after the invoice date.
If the client fails to pay on time and SSI refers the account to a third party for collection, all associated costs will be charged — including accumulated late fees, return cheque fees ($50), insufficient funds fees, collection agency fees, and court and attorney costs. Once referred to a collection agency, all correspondence and payments must be made through that agency.
On concrete over 10 years old, SSI will re-pump once within a five-year period, at no cost to the customer, if any area has resettled more than 0.5 inches. A re-pump uses the same holes as the original work.
A $150 service fee applies for any return visit for reasons not covered under this guarantee within the five-year period.
In no event shall SSI be liable for incidental or consequential damages, including loss of business or lost profits.
SSI’s maximum liability to the client for any work performed, whether in contract, tort, or otherwise, is $500 or the amount paid to SSI, whichever is greater. This is the client’s sole and exclusive remedy against SSI for work performed under this agreement.
The client is entitled to written lien waivers upon receipt by SSI of full payment as called for in the proposal.
The owner is responsible for carrying fire, tornado, and other necessary insurance on the work described. SSI carries business insurance and public liability insurance.
This agreement shall be construed and governed under the laws of Alberta, Canada, without application of conflict of law principles. All actions regarding this agreement shall be initiated and prosecuted exclusively in the provincial court sitting in, or the federal court having jurisdiction over, the region in which the work was performed.
Both SSI and the client consent to the jurisdiction and venue of such courts and expressly waive objection based on the doctrines of personal jurisdiction and forum non conveniens.
